Student Non-Discrimination Act

The Student Non-Discrimination Act (SNDA) which was introduced by Senator Franken (D-Minn.) seeks to establish a comprehensive Federal prohibition of discrimination in public schools based on actual or perceived sexual orientation or gender identity.

According to the 2009 National School Climate Survey, as many as 9 in 10 lesbian, gay, bisexual and transgender students have been bullied. Additional findings from the National Transgender Discrimination Survey revealed that those who expressed gender nonconformity while in grades K-12 reported alarming rates of harassment (78%), physical assault (35%) and sexual violence (12%). Feeling unsafe in school can lead to increased absenteeism, dropout rates, adverse health (including mental) consequences, and academic underachievement.

The Student Non-Discrimination Act builds on existing protections for students based on their race, color, sex, religion, disability or national origin, and will provide LGBT students and their families with legal recourse against discriminatory treatment.

I urge you to pass this important and long-overdue protection for LGBT students. This legislation will help to end discrimination against lesbian, gay, bisexual and transgender students and ensure safe learning environments.
